The major social, legal and judicial sensitization on the need to eradicate genderbased violence demands a suitable and effective response from all Public Institutions to safeguard the rights of the women. The principal aim of this article is to highlight the legislative solution given to this problem in relation with immigrant women (third-country nationals). Spanish and EC lawmakers have set out rules relating to gender-based violence for three groups of women: a) Married women or registered partners of European Union, EEE, (...) Swiss or Spanish citizens; b) Women married to third-country nationals; c) Women who are in Spain, married or not, in an irregular situation. The legislation analyzed in this paper regulates only the administrative situation to which women can accede when they are the victims of gender-based violence. That is to say, what types of authorizations can be granted and what possible “benefits” can be obtained, but only in the documentary area. Neither the penal or civil response to gender-based violence is analyzed. (shrink)

This paper aims to explore the association between over-indebtedness and two facets of well-being – life satisfaction and emotional well-being. Although prior research has associated over-indebtedness with lower life satisfaction, this study contributes to the extant literature by revealing its effects on emotional well-being, which is a crucial component of well-being that has received less attention. Besides subjective well-being, reported health, and sleep quality were also assessed. The findings suggest that over-indebted consumers have lower life satisfaction and emotional well-being, as (...) well as poorer health and sleep quality. Furthermore, over-indebtedness impacts life satisfaction and emotional well-being through different mechanisms. Consumers decreased perceived control accounts for the impact of over-indebtedness on both facets of well-being. Financial well-being, partly mediates the impact of indebtedness status on overall life satisfaction. The current study contributes to research focusing on the relationship between indebtedness, well-being, health, and sleep quality, and provides relevant theoretical and practical implications. RESUMEN El artículo responde algunas críticas planteadas por Ignacio Ávila a mi interpretación de la epistemología davidsoniana. Presento argumentos en contra de: a) que sea necesario distinguir entre representaciones epistemológicamente “peligrosas”e “inofensivas”; b) que el empirismo mínimo sea un tipo de realismo directo; c) que mi uso de la expresión “evidencia distal” y el interés por la teoría de la correspondencia sean asuntos ajenos a Davidson. Finalmente, sostengo que la triangulación es un elemento fundamental de la epistemología davidsoniana, pues permite (...) sortear la ansiedad realista manteniéndose en una postura no representacionalista. ABSTRACT In this article, I respond to some of Ignacio Ávila's criticisms of my interpretation of Davidson’s epistemology. I argue against: a) the need to distinguish between epistemologically “dangerous” and “harmless” representations; b) the idea that minimal empiricism is a kind of direct realism; and c) the claim that my usage of the expression “distal evidence” and interest in the theory of correspondence are issues that do not pertain to Davidson. Finally, I claim that triangulation is a key element in Davidsonian epistemology since it allows us to deal with the realist anxiety while maintaining a non-representationalist viewpoint. (shrink)

Both hypotheses are confirmed, if the identification of two new fragments is admitted.At 10. 11 p. 368, Zonaras is epitomizing the text of Caes.; he recounts the Story of Caes. 60. 3, and continues: Editors leave the provenance of the passage unspecified: ‘addita sunt pauca de nomine Caesaris‘. The correction of the vulgar error might (...) perhaps be an inference of Zonaras himself—though such an original contribution to historical polemic would be unique; but the erroneous version, at least, must come from somewhere. It is not found in any of Zonaras' sources for this period, nor in any surviving book which he certainly knew. Nor is it likely to be an addition from his own general knowledge. (shrink)

This note revisits the issue of Scipio Aemilianus’ famous prosecution of L. Aurelius Cotta, cos. 144, and argues for a reconstruction and dating that is consistent with both Per. Oxy. 55 and the references in Cicero. The appendix suggests that scholars have misunderstood Appian BC 1.22 and Cicero Font. 38 and that Appian (and perhaps Cicero) refer to another trial, namely that of L. Aurelius Cotta, cos. 119.

Although gas thermometers have long been the standard against which all other thermometers are checked, English-language physics textbooks usually propose experiments for students to test the linearity of the relationship, at constant pressure, between gas volume and temperature indicated by a mercury thermometer. This absurd exercise receives support from many authoritative textbooks which wrongly associate with Gay-Lussac's classic 1802 paper in Annales de Chimie—in which he announced that all gases have the same mean expansivity over the range 0 to 100°C—a (...) diagram of an apparatus he used, later, to compare mercury thermometers with air thermometers. This confusion is first found in Biot's Traité de Physique and has been perpetuated, with unfortunate consequences, by many subsequent authors. (shrink)

Singing and praying in the words of biblical men and women is basic to sacramental mimesis, i.e., Christian imitation of the actions of the saints with the intention of thereby opening themselves to grace. This evidence counters the “voiceless victim” paradigm prevalent in much feminist scholarship. In pre-Christian Jewish liturgy, the song of Miriam after the Crossing of the Red Sea was already important in the annual celebration of the Passover. Jesus emphasized the spiritual equality of the sexes in his (...) teaching and ministry, and this led to increased visibility for women in Christian tradition: Susanna was the first of at least eight women interpreted as types of Christ. She was presented this way even within the synoptic Gospels themselves [see “Aneboesen phone megale: Susanna and the Synoptic Passion Narratives,” forthcoming in Gregorianium]. Moreover, the practice of presenting examples from both sexes in sermons and church decoration was so pervasive as to constitute a pastoral program of the Church. Such balanced representation of the sexes is found in both texts and art. The linguistic range of the evidence for the singing of women’s words includes Greek, Latin, Coptic, Syriac, Slavonic, and German. The artworks depicting women are from throughout the Christian world, including Dura Europos, Jerusalem, Egypt, Ethiopia, Cyprus, Syria, Armenia, Italy, France, Belgium, Germany. More than twenty biblical women are treated in the essay. Women’s words, quoted from the biblical record or imaginatively supplied, became the prayer of the whole congregation. Miriam’s words remain focal universally on Holy Saturday. The acclamations of Elizabeth and of the Virgin Mary became prominent early in both East and West . Both Byzantine and Gregorian chant commemorated them and other women such as Eve, Esther, Judith, Sarah , Susanna, Martha of Bethany, the Samaritan woman, the Canaanite woman, the woman with the ointment, the Samaritan woman, the ten virgins of the parable , and especially the Holy Women at the Tomb . Their proclamation of the Lord’s rising became particularly important in Byzantine resurrection hymns used at Easter and year-round. With four other first-century female saints– Junia, Mariamne, Photina and Thecla– Mary Magdalene was deemed ἰσαπόστολος “equal to the apostles,” because the angel commissioned her to announce the Lord’s Resurrection to the disciples. Martha’s profession of faith is the fullest recorded in the Gospels and became the basis for a Byzantine communion prayer . Repeatedly, one finds that women’s words were sung at important Sunday feasts and during Holy Week. In Gregorian chant their words were sung over the course of several days. Susanna’s words are readily found in fifty Gregorian chant manuscripts from the ninth through fifteenth centuries, used in cathedrals, in monasteries and other religious houses, and in parish churches; an appendix lists these manuscripts. Throughout the continent–in Italy, Austria, Slovenia, Germany, Switzerland, France, The Netherlands, England, Wales–the varied communities of the church sang Susanna’s words. Moreover, her words as mediated through Gregorian chant were quoted by Bernard of Clairvaux in a sermon and by Hermann of Scheda in his account of his conversion from Judaism. These men used Susanna’s words to evoke her as a type of Christ and thereby to seek to be like him themselves. That is, they experienced sacramental mimesis through singing women’s words. (shrink)

Background: Issues concerning legislation and regulation with respect to the role of nurses in euthanasia and physician-assisted suicide gave the Minister for Health reason to commission a study of the role of nurses in medical end-of-life decisions in hospitals, home care and nursing homes.Aim: This paper reports the findings of a study of the role of nurses in euthanasia and physician-assisted suicide, conducted as part of a study of the role of nurses in medical end-of-life decisions. The findings for hospitals, (...) home care and nursing homes are described and compared.Method: A questionnaire was sent to 1509 nurses, employed in 73 hospitals, 55 home care organisations and 63 nursing homes. 1179 responses were suitable for analysis. The questionnaire was pilot-tested among 106 nurses, with a response rate of 85%.Results: In 37.0% of cases, the nurse was the first person with whom patients discussed their request for euthanasia or physician-assisted suicide. Consultation between physicians and nurses during the decision-making process took place quite often in hospitals and nursing homes and less frequently in home care situations . In some cases , nurses administered the euthanatics.Conclusions: The results show substantial differences between the intramural sector and the extramural sector , which are probably linked to the organisational structure of the institutions. Consultation between physicians and nurses during the decision-making process needs improvement, particularly in home care. Some nurses had administered euthanatics, although this task is by law exclusively reserved to physicians. (shrink)

The dialogical principle, the organizational recursivity principle and the hologramatical principle, are the three principles can help us to think the complexity. The first one allows us to think how the duality can stay in the breast of the unit. The second lead us to the understanding of how the products and the effects are, at the same time, causes and products of what produces them. The third, and perhaps the most beautiful of three, refers that the part itself is (...) not only in the everything but rather the everything is also in the part. Three images can help us to clarify these principles: first, the process of mating of the hens produces hens, which produces the process of mating of the hens; second, the hens put eggs of where to come out more hens than put more eggs; third, a hen egg is a hen in potential. The configuration of a psychology of complexity is related with the application of this principles for the analysis of the social reality in several addresses: a) to win complexity in the explanatory and descriptive environments, opening diverse ways of thinking and novel investigation lines, accepting that the theories of the complexity have been related inevitably with the sciences of the behavior; b) to understand that the daily life can be studied from four optics that deserve recognition in the epistemological level of the social psychology: fuzzyness, catastrophic, fractal and chaotic; c) to recognize that reality demands scientific explanations complex and leave the simplicity; d) to renovate the psychology from their base and not from the obedience and the academic subjection. This article reports the findings of a study into the role of Dutch nurses in the alleviation of pain and symptoms with a life-shortening intention, conducted as part of a study into the role of nurses in medical end-of-life decisions. A questionnaire survey was carried out using a population of 1509 nurses who were employed in hospitals, home care organizations and nursing homes. The response rate was 82.0%; 78.1% were suitable for analysis. The results show that in about half of (...) the cases nurses were involved in the decision making by the physician and that nurses were frequently involved in administering the medication. The authors' conclusion is that alleviation of pain and symptoms with a life-shortening intention represents a `grey' area, in which physicians and nurses act on the basis of personal ethical norms rather than legal rules, professional guidelines or shared moral values. Every student of scholastic moral theology and ethics will thank the venerable Benedictine scholar for having given them the matter of the earlier volumes in the more convenient format of a single volume, with one table of contents and a single alphabetical index, and with a better arrangement of matter and certain important additional studies.

In recent years, to protect the rights and welfare of human subjects, institutions in the USA have begun to set up programmes to monitor ongoing medical research. These programmes provide routine, onsite oversight, and thus go beyond existing oversight such as investigating suspected misconduct or reviewing paperwork provided by investigators. However, because of a lack of guidelines and evidence, institutions have had little guidance in setting up their programmes. To help institutions make the right choices, we used interviews and document (...) analysis to study how and why 11 US institutions have set up their monitoring programmes. Although these programmes varied considerably, we were able to distinguish two general types. ‘Compliance’ programmes on the one hand were part of the institutional review board office and set up to ensure compliance with regulations. Investigators’ participation was mandatory. Monitors focused on documentation. Investigators could be disciplined, and could be obliged to take corrective actions. ‘Quality-improvement’ programmes on the other hand were part of a separate office. Investigators requested to be monitored. Monitors focused more on actual research conduct. Investigators and other parties received feedback on how to improve the research process. Although both types of programmes have their drawbacks and advantages, we argue that if institutions want to set up monitoring programmes, quality improvement is the better choice: it can help foster an atmosphere of trust between investigators and the institutional review board, and can help raise the standards for the protection of human subjects. Interpretations of the Philebus and of other Platonic and Aristotelian texts concerned with problems arising therefrom are carried out; they culminate in an analysis of the fruitful union of intellectual power and impotence in philosophy. The existentialist framework often provides suggestions for the interpretation of difficult transitions in the classical works; conversely, the adherence to the arguments of the Greek texts strengthens (...) the existentialist position with respect to such concepts as world and rationality.--C.
